Summary

This bill establishes that a person commits aggravated domestic assault who, intentionally or knowingly, commits an assault against a domestic abuse victim and the assault meets all of the following criteria:  Either i nvolves the use or display of a deadly weapon , or i nvolves strangulation .  Either r esults in serious bodily injury to another or in the death of another. This bill provides that such offense of a ggravated domestic assault is classified as a Class B felony and applies to offenses occurring on or after July 1, 2026. A Class B felony is punishable by a term of imprisonment of no less than eight nor more than 30 years , a potential fine not to exceed $25,000 , or both. "DOMESTIC ABUSE VICTIM"" DEFINED As used in this bill, a ""d omestic abuse victim "" means any of the following perso ns :  Adults or minors who are current or former spouses .  Adults or minors who live together or who have lived together .  Adults or minors who are dating or who have dated or who have or had a sexual relationship but not merely engaged in fraternization between two individuals in a business or social context .  Adults or minors related by blood or adoption .  Adults or minors who are related or were formerly related by marriage .  Adult or minor children of a person in a relationship that is described in above."
