An Act to Safeguard Personal Information and Strengthen Tenant Rights in Maine.
This bill would allow a person who is detained in a state facility on the basis of an allegation of being unlawfully present in the United States to appear in state court and present evidence that the person is erroneously detained or that the person is lawfully present or otherwise demonstrate that person's immigration status. After a hearing, the court may order the release of the person. This provision does not apply in the case of an alleged violation of criminal law or a violation of state law for which detention is authorized. The bill would allow the court to award a person actual and punitive damages for erroneous detainment.
