Summary

This bill would establish requirements for public libraries and school libraries to limit access to sexually explicit materials for minors by requiring public and school libraries to ensure that no sexually explicit materials are cataloged, located, or stored in the children's section of the library. The bill would require each library to establish a process by which residents can challenge the inclusion, placement, or presence of any sexually explicit material in the children's library. Failure to establish the challenge process by August 1, 2026 would result in a $500 civil penalty for each day that the library fails to develop and implement the challenge process. The bill would also provide a civil cause of action against any library violating the requirements of this act.
