Status: in_committee. Latest action: January 21, 2026.
AN ACT to amend Tennessee Code Annotated, Title 39; Title 43 and Title 57, relative to hemp.
This bill incorporates the definition of "hemp"" into criminal offenses within present law pertaining to minor smoking paraphernalia, and the prevention of youth access to tobacco, smoking, hemp, and vapor products. Present law defines ""hemp"" as the plant cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol (""THC"") concentration of not more than 0.3% on a dry weight basis. This bill redefines ""hemp"" to remove the distinction of th e delta-9 THC concentration, and clarifies that the term includes industrial hemp. However, the term does not include a ny of the following: Any viable seeds from a Cannabis sativa L. plant that exceeds a total THC concentration, including tetrahydrocannabinolic acid, of 0.3% in the plant on a dry weight basis. Any intermediate hemp-derived cannabinoid products containing: (i) cannabinoids that are not capable of being naturally produced by a Cannabis sativa L. plant, (ii) cannabinoids that are capable of being naturally produced by a Cannabis sativa L. plant and were synthesized or manufactured outside the plant, or (iii) more than 0.3% combined total of total THC, including tetrahydrocannabinolic acid and any other cannabinoids that have similar effects, or are marketed to have similar effects, on humans or animals as THC, as determined by the United States secretary of health and human services. Any intermediate hemp-derived cannabinoid products which are marketed or sold as a final product or directly to an end consumer for personal or household use. Any final hemp-derived cannabinoid products containing (i) cannabinoids that are not capable of being naturally produced by a Cannabis sativa L. plant, (ii) cannabinoids that are capable of being naturally produced by a Cannabis sativa L. plant and were synthesized or manufactured outside the plant, or (iii) greater than 0.4 milligrams combined total per container of total THC, including tetrahydrocannabinolic acid and any other cannabinoids that have similar effects, or are marketed to have similar effects, on humans or animals as THC, as determined by the United States secretary of health and human services."
