Title: AN ACT to amend Tennessee Code Annotated, Title 7, Chapter 51; Title 39 and Title 65, Chapter 15, relative to vehicles for hire.

Summary

CRIMINAL IMPERSONATION OF A TRANSPORTATION NETWORK COMPANY DRIVER This bill establishes an offense for a person who (i) impersonates a transportation network company driver by making a false statement; using a false display of distinctive signa ge or emblem known as a trade dress, trademark, branding, or logo of the transportation network company; or committing another act that falsely represents that the person has a current connection with a transportation network company; or (ii) falsely repr e sents that the person is responding to a passenger ride request for a transportation network company. This offense is generally a Class B misdemeanor, punishable by a term of imprisonment not greater than six months, a fine not to exceed $500, or both. H owever, if the violation occurs during the commission of a separate felony offense, then the offense is a Class E felony, punishable by a term of imprisonment not less than one year nor more than six years and a potential fine not to exceed $3,000. CRIMIN AL IMPERSONATION OF A PRIVATE PASSENGER FOR HIRE VEHICLE DRIVER. This bill establishes an offense for a person who (i) impersonates a passenger-for-hire vehicle driver by making a false statement; using a false display of distinctive signage or emblem kn own as a trade dress, trademark, branding, or logo of a passenger-for-hire vehicle; or any other act that falsely represents that the person has a current connection with a passenger-for-hire vehicle service; or (ii) falsely represents that the person is r esponding to a passenger ride request for a passenger-for-hire vehicle. This offense is generally a Class B misdemeanor. However, if theft of the passenger-for-hire vehicle has occurred, then this offense does not apply to the owner of the passenger-for- hire vehicle. As used in these provisions, a "passenger-for-hire vehicle"" means a motor vehicle that is designed or constructed to accommodate and transport not more than 14 passengers for hire, exclusive of the driver; principally operates within the co r porate limits of cities and suburban territory adjacent to the cities; and is not operated on a fixed route or schedule. ON MARCH 17, 2025, THE HOUSE SUBSTITUTED SENATE BILL 704 FOR HOUSE BILL 786, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 704, AS AME NDED. AMENDMENT #1 adds to both offenses that the person committed such offenses with an intent to deceive."
