Summary

This act continues the existence and functioning of the Alabama Behavior Analyst Licensing Board pursuant to the Alabama Sunset Law. This act amends Sections 34-5A-1 through 34-5A-7, inclusive, Code of Alabama 1975, to: (1) rename the board as the Alabama Behavior Analyst Advisory Council; (2) require the council to advise the Department of Mental Health on behavior analysis in the state; (3) transfer all rights, duties, property, and regulatory authority over behavior analysts of the board to the department; (4) authorize the department to adopt administrative rules to implement these changes; and (5) provide for the duties of the department and Mental Health Commissioner. This act also repeals Section 34-5A-8, Code of Alabama 1975, that subjected the board to the Alabama Sunset Law.
