Summary

This act proposes an amendment to the Constitution of Alabama of 2022, relating to Madison County, to: (1) require private sewer systems that use public rights-of-way to collect or dispose of sewage, discharge to certain wastewater treatment facilities, and bill customers flat fees or fees based on consumption to be certified and regulated by the Public Service Commission, including rates charged; and (2) provide procedures for the county, a municipality, or a governmental utility service corporation to enter into a rate control agreement with such a private sewer system to opt out of Public Service Commission regulation.
