Day care centers; creation of anaphylactic response policy by the Department of Human Resources required, implementation in day care centers required, employee training required.
This act adds Section 38-7-22 to the Code of Alabama 1975, to: (1) require the State Department of Human Resources, by August 1, 2027, and in consultation with the Alabama Department of Public Health and Alabama State Board of Pharmacy, to establish an anaphylactic response policy for children that provides guidelines and procedures required for day care centers and trained staff; (2) require by January 1, 2028, all day care centers to implement the anaphylactic response policy and provide the policy in writing to parents upon a child's enrollment; (3) beginning August 1, 2027, require all employees of licensed day care centers to biennially complete an anaphylaxis training program developed by the Alabama Department of Public Health; and (4) provide certain persons are not liable for actions taken pursuant to the policy, including making epinephrine available.
