Title: Minor elementary or secondary school students admitted to inpatient treatment; discl. of discharge.
Discharge plans for minors admitted to inpatient treatment; copies provided to public elementary and secondary schools; notification to parents; health records privacy exemption. Provides that, prior to the discharge of any minor admitted to inpatient treatment (i) who is a student at a public elementary or secondary school and (ii) for whom the facility to which the minor was admitted deems (a) additional educational services are needed or (b) such discharge poses a threat of violence or physical harm to self or others, such facility is required to provide to the mental health professional or school counselor at such minor's school the portions of such discharge plan relevant to the additional education services or threat of violence or harm to self or others. The bill requires such facility, prior to providing any such portions of such discharge plan to the mental health professional or school counselor at such minor's school, to provide to the parent of such minor reasonable notice of the types of information that will be included as part of any portion of such discharge plan and of the parent's right to, upon written request, refuse the inclusion of any such types of information or the provision of any or all parts of such discharge plan. The bill exempts the release of a minor's discharge plan to a public elementary or secondary school from health records privacy laws. The provisions of the bill have a delayed effective date of January 1, 2027.
