Summary

Present law prohibits a person who is experiencing a drug overdose and who in good faith seeks medical assistance for or is the subject of a request for medical assistance from be ing arrested, charged, or prosecuted for a drug violation if the evidence for the arrest, charge, or prosecution of the drug violation resulted from seeking such medical assistance. Present law provides that t his immunity applies to a person experiencing a drug overdose on the person's first drug overdose and that the responding law enforcem ent officer or the district attorney general's offic e may apply such immunity to a person 's subsequent drug overdose at the ir discretion. This bill expands the immunity to more than just the first drug overdose by removing these provisions.
