Present law requires a certificate of need prior to establishing or initiating operation of a nonresidential substitution-based treatment center for opiate addiction. An applicant for a certificate of need for such a treatment center must notify the county mayor of the county in which the facility is proposed to be located and the state senator and representative for the area within 10 days after filing the application with the health facilities commission (“ commission” ). An exemption applies in counties without an actively licensed acute care hospital; however, that exemption does not apply to these treatment centers. Additionally, a certificate of need is not required for a licensed hospital to operate such a treatment center if it is located on the same campus as the operating hospital. This bill removes nonresidential substitution-based treatment centers for opiate addiction from the list of institutions subject to these requirements and notice procedures . It removes the requirement these centers to obtain a certificate of need prior to initiation and repeal s the specific notification requirements for such applications. ADMINISTRATIVE FEES AND REPORTING Present law establishes requirements for administrative fees and coordination between the commission and the department of mental health and substance abuse services regarding specific administrative functions. A nnual reports must be submitted to the commission for various health services, including the operation of a nonresidential substitution-based treatment center for opiate addiction. This bill removes references to nonresidential substitution-based treatment center s for opiate addiction r elating to administrative fees for these centers and removes references to the department of mental health and substance abuse services from the commission's administrative duties related to these centers . T he requirement for these treatment centers to submit annual reports to the commission is also removed.
